Terms and Conditions

Your purchase of any tour from excursionsinmalta.com is subject to the following terms and conditions:-

1. Tour Cancellation and Changes: The Company reserves the right to cancel any tour without prior notification. All tours shall operate subject to a minimum participation. The Company reserve the right to cancel any tour for any reason. In the event of a cancellation by us, our sole liability will be limited to refunding the amount you paid for the tour. We will make reasonable efforts to inform you of any cancellation as soon as possible, ideally prior to the scheduled date of the tour.

Tours are also subject to changes for any reason. In the case of a major change, we reserve the right to cancel the tour. In other situations, we will offer alternative sites or activities to visit instead of those originally planned. You will not be entitled to cancel the tour or request a refund once the tour is booked and paid for, except as outlined below.

You have the right to cancel a tour you have already purchased, provided that the cancellation is made at least [7] days before the scheduled tour date. If you cancel within [3] days of the scheduled tour date, you will not be entitled to a refund, regardless of the reason for your cancellation.

2. Travel Documents: You are responsible for having all travel documents in place when touring with us abroad. We shall have no liability and shall not refund the price paid by you to us, where you are denied boarding or entry into a country due to incorrect travel documents.

3. Punctuality and Behaviour: You shall be punctual at all times whilst on tour with us. We shall have no liability whatsoever where you are left behind due to your lack of punctuality. We also reserve the right to require you to leave a tour where we, in our entire discretion, deem your behaviour to be offensive or a nuisance to others. We shall have no liability whatsoever towards you in any such case.

4. For tours that include pick-up and drop-off: pick-up points may be from your hotel or from nearby designated meeting locations. You are requested to be punctual in location according to the time stated, however, expect some waiting time until transport arrives. Pick-up times and meeting places will be given via confirmation email.

5. For tours that include transport between one site to the next, alighting from the vehicle and walking with the tour guide is expected. This mainly, to reach sites, museums, churches and pedestrianised areas within fortified cities.

6. Always take any vouchers or documents provided during purchase.

7. Bookings preferably 48 hours in advance.

8. For walking tours, please use comfortable and seasonally appropriate footwear. Avoid flipflops.

9. Dress appropriately according to the season.

10. For tours that include church visits; to enter churches, shoulders must be covered, and clothing must reach the knees.

11. On full-day tours, where lunch is included, please contact us with any intolerance or dietary requirements.

12. In the summer months, make use of hats and sunblock. Please wear comfortable shoes. Always keep well hydrated and avoid excessive consumption of alcohol.

13. ATTENTION PLEASE: guests with mobility challenges or using a wheelchair, kindly contact us for more information and guidance for the selected tour.

14. Bags and any personal items have to be attended to at all times. The company will not be held responsible for any damages or loss of personal items while on tour. Guests are expected to stay with the guide and follow any instructions while on tour. Should you wish to disengage from a tour, kindly advise the guide.

15. For powerboat tours:

• Persons with heart conditions, back conditions, and pregnant women are not allowed to board the powerboat.
• Passengers have to be seated for the duration of the whole ride
• Children under 12 years have to be accompanied by an adult (18+)

16. For Electric buggy, Jeep and Quad bike tours:

• Not advisable for pregnant women and people with severe back problems.
• For self-drive, drivers need to present their driver's license on the day of the tour and be between 21 and 74 years of age
• Anyone suffering from any type of body ailments, such as backaches, recent injuries etc should not take this tour.
• Guests must sign a disclaimer that they have no hidden physical injuries or are in a recovery period.
• Persons suffering from epilepsy or similar issues must not join this tour.
• There may be some walking to see hidden sites such as caves.

17. For segway tours:

• Children must be accompanied by an adult Minimum age is 12 years
• Not permitted for pregnant women
• Weight requirement is between 45KG (100lbs) and 113KG (250lbs) Operates in all weather conditions, please dress appropriately

18. For boat tours and cruises, the company reserves the right to alter or cancel this excursion according to prevailing weather conditions.

19. Electronic Communications: We shall have the right to correspond with you by means of internet or other electronic media or provide information to you in other electronic form. Because of the inherent risks associated with the electronic transmission of information on the internet or otherwise, we cannot guarantee the security and integrity of any electronic communications or information sent or received by us. We shall not therefore incur any liability with respect to any such communications or failure to receive same.

20. Liability and Indemnity: To the extent permitted by law, we shall have no liability whatsoever for any loss, damage, direct, indirect or consequential loss however caused incurred by you whilst you are on tour with us, other than liability for death or personal injury. We shall have no liability whatsoever with respect to those parts of the tour that are provided by third parties wholly independent of us. In the event that we are found to be liable, our liability towards you is limited to the price of the tour paid by you to us.

You shall indemnify us for any damages incurred by us, as a result of your acts or omissions, whilst you are on tour with us.

21. Complaints: Since Excursions in Malta is an excursion broker in Malta, any complaints that may arise about any of the excursions are to be addressed directly with the supplier of the particular excursion. This would need to be made during or up to 48 hours after the excursion. Any complaints made other than as stated above would unfortunately not be considered valid. Excursions in Malta will do its utmost to support its esteemed guests with any matters that may arise.

22. Governing Law and Jurisdiction: These terms and conditions are subject to Maltese law, and the Maltese courts shall have exclusive jurisdiction to deal with any dispute arising between us with respect thereto.
